A year after San Francisco restaurant Zuni Cafe implemented a mandatory service charge in lieu of tips, staffers say the move hasn't helped.

As someone in the industry I'll tell you all a dirty little secret. When a restaurant institutes a service charge instead of a gratuity system it is then legally entitled under California law to control the money and distribute it any way it chooses to. Under the gratuity system if an owner tries to control tip money, short a server of their tips, or redistribute the tip money as it chooses to instead of paying it to the server it is illegal and is called wage theft.
